In a recent decision, a trial court in Nebraska found in favor of a surety represented by Levy Craig. To be efficient, the only people attending the trial on behalf of the surety were Shane Mecham and a client representative. Mr. Mecham brought claims to enforce the surety’s indemnity rights against a construction bond principal and related guarantors. This case was unique because the principal filed unusual counterclaims against the surety. There was no Nebraska law on point, but Shane was able to convince the judge to ignore the principal’s novel theories in favor of enforcing the surety’s indemnity agreement.
