Levy Craig wins summary judgment and advances Missouri real estate law in the process

Levy Craig recently prevailed on behalf of its clients in a case of competing summary judgment motions. A home in Cass County, Missouri, had been serviced by a gas line until the home unfortunately burned down in 2007. When the property owners rebuilt, the gas company refused to reconnect the line and claimed that the easement was limited to the prior home. In a case of first impression in Missouri, Attorneys Allexia Kallsen and Mike Tamburini convinced the Cass County Court that the gas line lien ran with the land and was enforceable as to any house that exists on the property. Levy Craig is thrilled to deliver this result to our clients, who will be able to use their home as intended, and to once again be on the cutting edge of Missouri real estate law.
